New Bill Could Amend ERTC Due Date
AAFCPAs would like to make clients aware of a new bill that has reached congress titled The Tax Relief for American Families and Workers Act of 2024, a vote for which is anticipated by January 31, 2024. If passed, this bill could amend the due date of Employee Retention Tax Credit (ERTC) filings to January 31, 2024 versus previous due dates, below.

This new bill, having been introduced at such a late date, can be a cause of uncertainty. While we cannot say whether the bill will pass or if its amended deadline will be upheld, we advise that clients plan proactively for a January 31, 2024 deadline as a precaution. As of the date of this publication, the current ERTC deadlines remain in place.
If you already submitted a claim and have not received your refund, please reach out to your AAFCPAs advisor regarding next steps. We recommend that members of professional employer organizations (PEOs) reach out to their payroll administrator and ask about their plan to file open claims in a timely fashion based on this pending updated due date. If you have not applied for the ERTC as of yet, we advise that clients pause and take a wait and see approach.
