On May 31, 2023, Massachusetts Attorney General Andrea Joy Campbell enacted several important changes to the state charity filing, the Form PC. AAFCPAs has highlighted the changes below and how they will affect Massachusetts nonprofit organizations.
Mandatory Filing of Form PCs through Online Charity Portal
Effective September 1, 2023, all Form PC filings which are coming due or on extension will now need to be filed through the Massachusetts Online Charity Portal. Paper submissions of the Form PC are no longer being accepted post September 1. Additionally, charities using tax preparation software will still need to use the Online Massachusetts Portal as third-party tax software cannot electronically file the Form PC.
Charities may now log in and sign their Form PCs electronically, eliminating the need for signatures on paper filings.
Increase in the Revenue Floor that Requires an Attached 990 Filing
Effective immediately, Massachusetts Charities that have gross support and revenue of $25,000 or less will no longer need to include a Form 990EZ with their Form PC. This increases the floor from the previous level of $5,000. This is an important change for small Massachusetts nonprofits, as the Form 990EZ is more voluminous than the 990N, which is their federal filing requirement. This change will ease the administrative burden on these smaller Massachusetts Charities.
