Kelly is a senior leader in AAFCPAs’ Commercial Tax practice. She advises individuals, partnerships, corporations, nonprofits, and trusts operating in multiple states and municipalities on opportunities to save tax dollars through advanced tax planning and risk mitigation. This includes the identification of all location-specific tax incentives and credits that could impact business entities and their owners.
Kelly brings expertise in nexus analysis for income/franchise tax and sales and use taxes along with the analysis of state and local tax aspects related to the purchase and sale of a business. She reviews potential tax exposure in support of financial statement reporting under FIN 48, prior year state and local tax returns for potential refunds, and payroll and pass-through entity withholding requirements. Kelly works with clients to evaluate internal accounting processes used to capture data required for multi-state and local tax compliance and planning along with sales tax compliance studies. Beyond this, she evaluates voluntary disclosure and amnesty programs, assisting with formal and informal ruling requests and providing state and local tax audit representation, as needed.
In addition to her work with commercial clients, Kelly assesses sales and payroll tax issues for nonprofit organizations. In this capacity, she provides nexus analysis, determines whether sales are subject to sales tax, and assists with compliance set up. She also analyzes employer withholding tax requirements based on where employees live and work to ensure all federal and state requirements are met.
As state and local needs for new revenue sources have grown nationwide, government entities have become increasingly aggressive in pursuing new taxation opportunities wherever possible. Kelly keeps her finger on the pulse of state and local tax changes including developments in state conformity with the Internal Revenue Code (IRC). She leverages her knowledge of tax strategies and structures to help clients avoid noncompliance penalties and effectively manage and plan for the continuously evolving complexities of multistate taxation.
